Russian MP3-store offers LordLandless-CD
Have a look at this, and cry. Or help me eat the carpet. This Russia-based MP3-shop offers "Garden of the Lost" for a total of 6.24$. Of which, of course, neither Silva and me nor Volker and Kirstin will ever see a Cent.

I notified Volker of it and he sent them something like a C&D-letter, but after all I've heard about the battle between the music industry and the Russian MP3-shops, I doubt they'll even reply...

This is worse than Emule or other means of filesharing - this is someone who is willing to make money with our work. I hate them. I really do. We're not Sony BMG or Robbie Williams. We've got a speacial CD for a special audience, and for us, each sale counts. I'm not talking peanuts.

And what freaks me out most is that someway they must have gotten hold of our CD. How did they get it?`Where's the leak? Who fed my CD to the Russians? I doubt I'll ever learn.

One quite successful possibility is to go after its credit card processing and its providers. The DNS provider is a German company and thus subject to German legislation, the credit card clearing provider subject to USA legislation.

We had a similar problem about a year ago - and going after the danish provider (who had a German office, too) cancelled the site within 24 hours. This time it will not be as easy as the server hosting is done in RUS, not DE or at least EU.
The downloads itself are seemingly done via botnetted PCs - which seem to be utterly unreliable. I have not been able to download a single sample snippet of the CD from there yet.

Nor did I. I wanted to know about the sound quality (and more reason to freak out).
I've got a legal expenses insurance, just in case we need it. I don't know if they cover copyright issues, though. Could ask them.

Sorry for making this a public post. I intended to make it friends only, but for some unknown reasons my "Friend"-entries are invisible even in my friends journals...

That sucks. The people who want to throw out copyright along with the ridiculous excesses of the recording industry ought to consider what that would mean to people like you.

I agree with [info]highstone- public is good. It lets people know not to give these guys money. Ever.

However, once the initial outrage fades, let's take this into perspective.

As a musician, piracy exists. Your work *will* be stolen in many forms. People will not ask you for permission. The whole point of copyright is to give the composer some benefit from their work within their lifetime. However, the social reality is that the arts become a part of our cultural backdrop and at some point enter the community consciousness. Once that happens, our babies are beyond our control.

And in reality, that happens the first time we sing in public.

Does that mean that we let something like this pass by? Hell no!

It does mean, however, to try not to lose sleep over it. It's a reality of being a recording artist.

What can I say? Serves us right for being filkers? Aren't filkers, of all musicians, rumoured for caring little for other people's copyright? I filked Dr. Hook, you filked The Who - still, I think this is different. What we do, we do out of love and respect -whilst these people act on nothing but sheer greed. And greed doesn't work well with filkers.

No, I think you miss my point. I do not feel that what they've done is *right*. I agree that this is theft, pure and simple.

What I am saying is that ALL artists are exposed to this type of theft, and can be victimized by it to a greater or lesser extent. At least these guys are selling a Lord Landless CD, and didn't rename it to someone else and claim credit for it (remember Milli Vanilli?). So, if someone should actually *buy* from these guys, the purchaser will still know it's YOUR work, and do not think it is someone else's.

Which means the messages on your CD get out to more people.

You have the ability to choose how you feel about it. Is this pure theft, or an opportunity to be heard by more poeple? And, given the number of other artists on their site, what are the actual odds that they'll sell a CD or two?

Yes, it's wrong. And there's a principle behind it. In the end, though, exactly how much money are we dealing with here, and what are the odds of recovering it?

Hence my statement- be concerned- let people know you don't like it and don't support them; then go on with life.

On topic:
I did some additional research an found three more shops who offer Lord Landles, but luckily, I didn't find your CD, or Summer&Fall's.And I hope the V-man can sort this out...

Although Steve's right, of course, the feeling of having lost the work to those people would eat me up.

I once found bits of "IV" in a French site for downloads. Mind you, I don't think we lose a lot of money, since no one knows us anyway.

No, I'm realistic on that. I don't think we'll lose any sells - people who download on AllofMP3 wouldn't have bought the CD in the first place. And I doubt anyone will buy the MP3s anyway. Still, it freaks me out, the very idea of folks who even think of making money with my work without caring for my rights.

I can understand that you're mad at them, but I also think that Steve has got a point. Do what you can to get to those idiots, but don't let them get to you that much - they aren't worth your nerves.

Still - I keep my fingers crossed that you can do something against them!
